Agreement and Relationship
These Terms of Use apply to your access and use of all platforms, applications, websites, content, and services provided by MD Travels, located at Shop No.225, Shopping Square-2, Sector-D, Sushant Golf City. Ansal API Lucknow 226030. By continuing to use our services, you accept and agree to be bound by these terms. If you do not agree with any part of these terms, you must refrain from accessing or using our services. These terms replace all previous understandings or agreements between you and MD Travels. We reserve the right to suspend or terminate your access at any time, without prior notice.
In certain cases, additional terms may apply to specific services, offers, or events, and those terms will be communicated to you as applicable. If any conflict arises between these terms and additional conditions, the latter will take precedence. If you are involved in an accident or dispute with a third-party transportation provider, MD Travels may disclose necessary personal information to insurers or claim processors to assist with resolving the issue.
Scope of Services
MD Travels offers a booking interface through its website, mobile applications, and customer service center to connect users with independent third-party transportation providers. Our platform is intended for personal, non-commercial use unless a separate written agreement specifies otherwise. By complying with our terms, you receive a limited, non-transferable, non-exclusive, and revocable license to access and use our platform and content strictly for personal purposes.
Users are not permitted to alter, copy, sell, disassemble, or disrupt any part of our services. Accessing any restricted area of our platform without authorization is prohibited. Transportation services may be fulfilled either by MD Travels affiliates or by verified independent drivers holding appropriate licenses and permits. We may integrate or display services from external providers; however, MD Travels does not control or guarantee the quality or performance of these third-party services. All intellectual property rights to the content and structure of our services remain with MD Travels or its licensors. No rights are transferred beyond the granted usage license.
User Responsibilities
To use our services, you must register an account with valid personal details and be at least 18 years old. Only one account is permitted per person unless explicitly allowed. If you are an affiliate or sales partner booking rides on behalf of others, you are also bound by these terms.
Users must follow all applicable laws while using our services. Unlawful or unsafe behavior is strictly prohibited. Any activity causing disturbance, damage, or involving alcohol, smoking, or substances is not permitted. MD Travels may substitute vehicles within the same class if required. Unauthorized changes to bookings, such as modified destinations, may result in extra fees.
Requests for refunds or changes based on personal preferences, religion, gender, caste, or age will not be entertained. Complaints against drivers or service partners will be reviewed individually, with serious concerns like harassment addressed with urgency. By using our services, you agree to receive communication via SMS for booking confirmations and service updates.
Promotional codes issued by MD Travels are non-transferable, not redeemable for cash, and may be withdrawn at any time. Misuse of such codes may lead to suspension of benefits or services. If you submit any reviews, feedback, or user-generated content, you grant MD Travels a worldwide, royalty-free license to use, modify, and distribute that content. You must have the rights to the content and ensure it is lawful and not offensive. We reserve the right to remove such content at our discretion.
Users are responsible for their own data charges and device compatibility when accessing our services. We cannot guarantee that all features will function across all networks or devices.
Payments and Charges
All service payments are processed by MD Travels on behalf of third-party providers and are considered final unless explicitly stated otherwise. Users may negotiate reductions with providers directly, but MD Travels does not guarantee adjustments. Payment is due at the time of service, and users will receive an email receipt.
Pricing is dynamic and may vary depending on demand, location, or promotions. Funds added to wallets or in the form of vouchers serve as booking advances and may be modified or canceled by MD Travels at any time. Advance payments are non-refundable, and cancellation fees may apply. Tips and gratuities are not included in base fares and are left to the discretion of the customer.
Additional payments requested by providers that are not shown in the app or prior agreement should not be paid. MD Travels is not liable for any such extra payments made by the user. Any tolls, parking fees, or taxes incurred during the trip must be paid by the passenger, and a receipt should be requested directly from the provider.
If a user shortens a ride or returns earlier than planned, the original fare remains applicable. Late-night extensions beyond midnight are subject to additional hourly or next-day charges. Any upgrade fees or add-ons, once availed, are non-refundable. If an add-on is not delivered, only that specific fee will be refunded, and the trip fare will not be affected.
Users are responsible for any vehicle damage beyond typical use and for excessive cleaning. Verified repair or cleaning charges will be billed accordingly. Traveling with pets requires prior notification and may include extra charges based on vehicle type.
MD Travels may change the commission structure for its sales partners at any time. Commissions are only released post-trip and can be withdrawn once the minimum threshold is met. A valid PAN number is required to process payments.
Disclaimers, Liability, and Indemnification
MD Travels provides all services on an “as is” and “as available” basis. We disclaim all implied warranties, including those related to fitness for a specific purpose, performance, or reliability. We do not guarantee uninterrupted service or specific outcomes. Interactions with third-party drivers and use of their services are entirely at your own risk.
MD Travels is not responsible for any damages, financial losses, personal injuries, or other liabilities resulting from the use of our services. Our total liability, in any case, is limited to ₹500. We are not liable for negligence or failure by third-party providers to follow regulations, including health or safety rules such as COVID protocols. Any required permits, passes, or documentation for travel must be arranged by the user.
It is the user’s responsibility to verify the driver and vehicle before boarding. If you do not board the assigned vehicle, MD Travels holds no liability, and your payment will be forfeited. We are also not responsible for delays, missed connections, or schedule disruptions caused by weather, traffic, or mechanical issues.
Complaints submitted after three business days from the completion of a ride may not be entertained. We reserve the right to cancel bookings without notice. Technical errors, system failures, or user misuse are not our responsibility. Luggage limits apply based on vehicle type (2 bags for sedans, 4 for larger vehicles), with each bag not exceeding 32 kg or 158 cm in total dimensions.
If items are lost during travel, MD Travels will attempt to assist in recovery, but retrieval and verification are the user’s responsibility. A handling fee may be applicable. Service continuity is not guaranteed. Users must also ensure their contact details are accurate, as MD Travels is not liable for communication failures.
By using our services, you agree to indemnify and hold harmless MD Travels, its affiliates, and employees from any claims, losses, or damages resulting from violations of these terms or misuse of the platform.
Applicable Law and Dispute Resolution
The laws of India govern these terms. Any disputes will first be addressed through mutual discussion within 30 days of notification. If unresolved, disputes will proceed to arbitration in Lucknow, under the Arbitration and Conciliation Act, 1996. Arbitration will be conducted by a panel of three arbitrators, one appointed by each party, and a third acting as the presiding arbitrator. Any remaining legal proceedings shall fall under the jurisdiction of lucknow.
General Terms
Infringement of copyright or intellectual property should be reported using the contact information on our website. All formal communications may be delivered through website notifications, SMS, email, or postal mail. You may reach us through the contact details provided on the site.
You may not assign your rights or obligations under these terms to another party without our written consent. MD Travels reserves the right to transfer or assign its rights, including as part of any merger or business acquisition. These terms do not establish any partnership, joint venture, or employment relationship between you and MD Travels.
